1. Acceptance of Terms

By accessing or using Kapitol.ai, you agree to be bound by these Terms of Service. If you do not agree, do not use the service. These terms apply to all users, including visitors, free users, paid subscribers, and API customers.

2. Description of Service

Kapitol.ai provides a subscription-based platform that tracks, scores, and analyzes publicly available stock trade disclosures filed by members of the United States Congress under the STOCK Act. The service includes trade alerts, analysis, and related tools. We also offer the Kapitol API, a separate developer product providing programmatic access to the underlying trade data.

All congressional trade data we display is derived from public government disclosures. We collect it first-hand from the public U.S. House and Senate disclosure systems, supplemented by a historical dataset of public disclosures. We do not create, fabricate, or modify any trade data.

3. Not Financial Advice

Kapitol.ai is an informational platform only. Nothing on this platform constitutes financial advice, investment advice, trading recommendations, or any form of professional financial guidance. See our full Disclaimer for details.

4. Subscriptions and Payment

• Our newsletter is free to subscribe to; full access to the platform requires a paid subscription
• Subscriptions are billed monthly, annually, or every 3 years through Stripe at the prices shown on our pricing page
• New subscriptions may start with a $1 introductory 7-day trial, limited to one trial per customer. At the end of the trial, the selected plan is charged unless you cancel before the trial ends
• We may offer other promotional pricing from time to time; the terms of any promotion are stated at the point of offer
• You may cancel your subscription at any time from your account settings or the Stripe customer portal
• Cancellations take effect at the end of the current billing period (no partial refunds are issued)
• We reserve the right to change pricing with 30 days notice to existing subscribers
• Failed payments may result in suspension of access until resolved

5. The Kapitol API

The Kapitol API is offered under separate plans, billed monthly or annually through Stripe:

• Free: for evaluation only. Limited to recent data, on a delay, with low rate limits, and no commercial use
• Starter, Pro, and Scale: paid tiers with real-time data, full history, commercial use, and progressively higher rate and usage limits

You are responsible for keeping your API keys confidential and for all activity under your account. We may throttle, suspend, or terminate API access for exceeding your plan's limits, for abuse, or for non-payment. Plan limits and pricing are described on the developer pages and may change with reasonable notice.

6. User Responsibilities

You agree to:

• Provide accurate registration information
• Keep your account credentials and API keys secure and not share them
• Use the service for lawful purposes only
• Not scrape, copy, or redistribute our content or analysis outside the terms of your API plan
• Not use the service to manipulate markets or engage in market abuse
• Not attempt to reverse-engineer or interfere with the platform

7. Intellectual Property

All original content on Kapitol.ai (including trade analysis, context stories, scoring methodology, and platform design) is the property of Kapitol.ai. Underlying congressional disclosure data is public record.

You may not reproduce, redistribute, or commercially exploit our original content without prior written permission or a commercial API plan that permits it.

8. Disclaimer of Warranties

The service is provided "as is" without warranties of any kind. We do not guarantee the accuracy, completeness, or timeliness of any information on the platform. Congressional disclosures may contain errors, delays, or omissions beyond our control.

9. Limitation of Liability

To the maximum extent permitted by law, Kapitol.ai and its operator shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the service, including but not limited to investment losses, loss of profits, or data loss.

Our total liability to you shall not exceed the amount you paid for the service in the 12 months preceding the claim.

10. Termination

We reserve the right to suspend or terminate your account at any time for violation of these terms, fraudulent activity, or abuse of the service. You may delete your account at any time by contacting us at hello@kapitol.ai.

11. Governing Law

These terms are governed by the laws of the Netherlands. Any disputes shall be subject to the exclusive jurisdiction of the courts of the Netherlands.

12. Changes to These Terms

We may update these terms from time to time. We will notify registered users of material changes via email. Continued use of the service after changes constitutes acceptance of the updated terms.
